The new Law on special conditions for recording and registering rights to immovable property changes the method of legalization in Serbia. Find out who can apply, what are the deadlines, costs and risks.
With the adoption of the new law, the previous Law on Legislation ceases to be valid. All started procedures are suspended, and a digital, massive and accelerated procedure for registration of illegal buildings is introduced.
The law enables the registration of rights on buildings built without a permit, with a temporary permit or those visible on satellite images. The application is submitted electronically, and the registration in the cadastre is performed by the RGZ without a separate administrative procedure or fee.
Fees:
Belgrade (extra zone): €1,000
Belgrade (I zone): €800
Larger cities: €500
Smaller municipalities: €100
Social categories are exempt from payment.
Risks and limitations
The law does not guarantee the safety of buildings - the owner bears full responsibility.
The application deadline is only 60 days, and there is no appeal against the Agency's decisions.
Buildings on public or protected land can be registered in favor of the state, while owners of buildings on other people's land have 5 years to resolve property relations.
Conclusion
The new law accelerates registration and brings administrative efficiency, but at the cost of legal certainty.
